Hamilton Pharmaceutical Pty Ltd and Compliance with Privacy Legislation - Collection Disclosure Introduction

The amendments to the Australian Privacy Act that are effective from 21 December 2001 extend the application of the National Privacy Principles ("NPP's") to personal information kept by private organisations such as Hamilton. The NPP's include requirements for disclosure related to the collection of personal information. At or before the time (or, if that is not practicable, as soon as practicable after) an organisation collects personal information about an individual from the individual, the organisation must take reasonable steps to ensure that the individual is aware of:

  • the identity of the organisation and how to contact it
  • the fact that he or she is able to gain access to the information
  • the purposes for which the information is collected
  • the organisations (or the types of organisations) to which the organisation usually discloses information of that kind
  • any law that requires the particular information to be collected
  • the main consequences (if any) for the individual if all or part of the information is not provided

NPP 1.3 provides that collection disclosure may be verbal or in writing. Responsibility All Hamilton employees who collect personal information about individuals are responsible for ensuring that Hamilton makes appropriate collection disclosure. The Finance Director is available to assist in matters of policy and administration. It is preferable that collection disclosure be made in writing by including a statement in the document or other media form (eg website) that is used to collect the information. The disclosure should be included in any communication made using the personal information (eg newsletter). Form of Collection Disclosure The form of collection disclosure may depend on the nature of the personal information being collected. The following general example is provided of collection disclosure required in the case of consumers' names and addresses. Protecting Privacy Hamilton respects the privacy of individuals and is committed to the protection of personal information that it keeps in the course of conducting its business. If Hamilton does not collect information such as people's names and addresses, it may not be able to conduct certain aspects of its business and that may have an adverse effect on benefits provided for you. Hamilton may collect and use personal information for a number of purposes such as advising you about its products and managing enquiries. Personal information is not used or disclosed to other parties other than in accordance with the Australian Commonwealth privacy legislation. Personal information is not disclosed to other parties for marketing purposes. Please contact Hamilton if:

  • you want access to the personal information held by Hamilton about you
  • you want to revise that personal information
  • you do not want Hamilton to continue to use that personal information
  • you want to complain about some aspect of Hamilton's management of that personal information
